Bored Ape Yacht Club (BAYC) creator Yuga Labs has won a pre-trial summary judgement in a trademark infringement case against Ryder Ripps and Jeremy Cahen.
Yuga Labs accused the defendants of copying its NFT collection and called their lawsuit a "scam" targeting buyers with falsely equivalent NFTs in a "deliberate effort to harm Yuga Labs at the expense of consumers".
The defendants argued that their collection was a protected parody covered by the First Amendment, a claim that the judge rejected. Yuga Labs was awarded an injunction and monetary damages, the amount of which will be set at trial. The ruling is being hailed by some as a landmark victory for the Web3 industry, especially in holding counterfeiters and scammers to account.
