CFTC Adviser Chris Perkins Says U.S. Risks Falling Behind in Crypto

Chris Perkins, President of crypto-focused VC CoinFund and adviser to the Commodities and Futures Trade Commission (CFTC), has published a regulatory white paper warning that the US is at risk of falling behind in cryptocurrency.

Perkins, a member of the CFTC’s Global Markets Advisory Committee, noted that the US is trapped in a reactionary wave of regulation following the collapse of the FTX exchange, while other jurisdictions are opening up to the opportunity and moving ahead, such as Hong Kong and the European Union's just-passed crypto assets regulatory framework.

The white paper offers 10 recommendations for policymakers, including the regulation of centralized intermediaries but not decentralized technology, and prioritizing sandboxes and safe harbor programs aligned with SEC Commissioner Hester Peirce’s proposals.

Hester Peirce, a commissioner of the U.S. Securities and Exchange Commission (SEC), revealed at the ETH Denver event that the SEC is considering an Ethereum spot ETF, but currently "there is no information that can be disclosed." In addition, Hester Peirce believes that some of the choices made by the SEC are very strange, because when regulatory agencies drive entities out of the United States, they are actually pushing them beyond the control of U.S. regulatory agencies.

The SEC still requires Ripple to provide two years of audited financial statements, contracts for the sale or transfer of XRP to "non-employee trading counterparties" after the lawsuit was filed, and detailed amounts of "XRP institutional sales proceeds" received after the lawsuit was filed. In addition, the US Securities and Exchange Commission is seeking to penalize Ripple in the XRP lawsuit.
